Office of the Municipal Council, Bagha Purana

 In compliance to section 4 of the Right to Information Act, 2005, the following manuals are     hereby framed for publicity:-
 
1)      The particulars of its organization, function's and Duties :-
Muncipal Council, Bagha Purana came into existence in 1978 vide notification no: 13(1) 78-USLG (3) –179(SPL) Dated 07-09-1978 as notified area committee. Now this Council become Class-II Municipal Council vide notification no: 10/4/07-1LG3/2091 Dated 11.06.2007.
According to the Census 2001 total population of this town is 21,611/- and its area is 4 Sq.Km
                          The working of this Municipal Council is as per Punjab Municipal Act,1911, Punjab Municipal Account Code 1930, Municipal work Rules 1978, instructions issued by Punjab Government from time to time. The Municipal election of present council was held during September 2005. There are 15 wards in the town. At present there are 15 elected member and one ex-officio member i.e MLA. Of the Bagha Purana Assembly Constituency in this Municipal Council, Bagha Purana.Detail of member’s & their wards are as under :-

According to Punjab Municipal Act 1911 the meeting of the council is held each month. The council passed the resolution for development activities and gives more basic amenities to the public. The resolutions are implemented by the office under the Act. The term of this committee is 5 years as depicted in Section 13(1) of the Punjab Municipal Act 1911.
 2 ) Powers and duties of its Officer and employees :-     
                 According to Section 50-B of the Punjab Municipal Act, 1911 the following functions and duties are being performed by this Municipal Council keeping in view its limited sources of income:The following duties have been assigned to the officers and employees of this Municipal Council : -
                                                   I.            The preparation of plans for economic development and social justice.
                                                  II.            Urban planning including town planning.
                                                III.            Regulation of land-use and construction of building.
                                                IV.            Road and bridges.
                                                 V.            Water Supply for Domestic, industrial and Commercial purposes.
                                                VI.            Public Health, Sanitation conservancy and solid waste management.
                                              VII.            Urban forestry, protections of the environment and promotion of ecological aspects.
                                             VIII.            Safeguarding the interests of weaker sections of society, including the handicapped and mentally retarded.
                                                IX.            Slum improvement and up gradation.    
                                                 X.            Urban poverty alleviation.
                                                XI.            Provisions of urban amenities and facilities such as parks, gardens and playgrounds.
                                              XII.            Promotion of cultural, educational and aesthetic aspects.
                                             XIII.            Burials and Burial grounds, cremations, cremation grounds and electric crematoriums.
                                            XIV.            Cattle pounds and prevention of cruelty to animals.
                                              XV.            Vital statistics including street lighting, parking lots, bus stops and public conveniences.
                                            XVI.            Regulation of slaughter houses and tanneries.
                               
A.              Power of President : -                                                                                                                           
                                                   I.            To call the meeting every month of the Council as provided in section 25 of the Punjab municipal act, 1911.                                                       
                                                  II.            To preside over the meeting as provided in section 28 of the Punjab municipal act, 1911.    
                                                III.            To decide any motion by second or casting vote in case of equality of votes as provided in section 29 of the Punjab municipal act, 1911.                               
                                                IV.            President has the extra ordinary powers in case of emergency as provided in section 35 of the Punjab Municipal Act 1911 can be used for the execution of any work and can direct to pay its expenditure out of the municipal fund but it should be laid down in the next meeting of the committee.                      
                                                 V.            To sign all the cheques for making payment out of the municipal fund along with the executive officer as per provisions contained in rule XII-4(1-A) of the Punjab municipal account code.1930.                                               
                                                VI.            To accept the tenders as contained in rule XIII.4 of the Punjab Municipal account code 1930.                                                                                 
                                              VII.            President has the power to sanction non – refund able and final payment of G.P.F. to all the employees as per appendix B appended to the Punjab Municipal Employees pension and General Provident Fund Rules,1994.
                                             VIII.            To countersign all T.A. Bills as per Rule XII 10(3) of the Punjab municipal account code, 1930.              
                                                IX.            The President every year in the month of April, shall record his opinion about the working of the employees of the committee in their character sheets.                                                  
 
B.         Powers and duties of Vice President :-              
Under the control of President of when the President is absent from Municipal Council, the Vice President may exercise these powers.
                                                                                      
Responsibilities and duties of Authority
C.            Executive Officer :-                        
                                                I.               He is the principal Executive Officer of the Committees as per rule 3 (1) of the Punjab Municipal Executive rule 1976.
                                               II.               To sign cheques of Municipality along with President as contained in rule XII . 4 (I-A) of the Punjab Municipal Account code 1930.
                                             III.               Financial Powers as delicate by the committee.
                                             IV.               To prepare annual Budget as per rule 11 . 2 of the Punjab Municipal Account code 1930.    
                                              V.               The Executive Officer shall be responsible for the general control of the municipal office.   
                                             VI.               The Executive Officer shall be competent to transfer any employee from one branch of another in the Committee.                                                   
                                           VII.               All communications addressed on behalf of the Committee to the State Government or the Government Officers shall be signed by the Executive Officer.                           
                                          VIII.               The Executive Officer shall be responsible for carrying out, either himself, or under his orders, all auctions for the disposal sale, lease or otherwise of Municipal property.
                                             IX.               Every year in the month of April the Executive Officer, shall record his opinion about the working of the employees of the committee in their Character sheets.                                 
                                                                             
D.           Power and duties of Inspector :-                                                                              
                                                I.               He performs his duties in field/office under the instruction of Executive Officer.
                                               II.               Power vested by Punjab Municipal Account Code 1930 for the purpose of Taxation.
 
 
 
 
E.            Power and duties of Sanitary Inspector/Supervisor :-                                                                                    To supervise the sanitation works, sewerage and disposal works.                                        
F.             Power and duties of Asstt. Municipal Engineer :-                                                                            
                                                I.               To check and supervise the development works, building constructions, maintenance of development Works.   
                                               II.               To sanction technically all the estimates upto Rs. 5.00 lakh as per provisions of the rule of the Punjab Municipal Works Rue 1978.
                                             III.               Prepration Preliminary plan etc. as per rule of the Punjab Municiapl Works Rule 1978.         
                                             IV.               Power vested in the Punjab Municipal Works Rules 1978.                                            
                                              V.               Power vested in the Building by laws of M.C, Bagha Purana.                                                         
G.           Power and duties of Junior Engineer :-                                                                                              
                                                I.               To check and supervise the development works, building constructions, maintenance of development Works
                                               II.               To sanction technically all the estimates upto Rs. 1.00 lakh as per provisions of the rule of the Punjab Municipal Works Rue 1978.
                                             III.               Prepration Preliminary plan etc. as per rule of the Punjab Municiapl Works Rule 1978.         
                                             IV.               Power vested in the Punjab Municipal Works Rules 1978.                                            
                                              V.               Power vested in the Building by laws of M.C, Bagha Purana.          
                                   
H.           Power and duties of Accountant :-                                                                                                     
                                                I.               All works related to Accounts of M.C.Bagaha Purana(To conduct and supervise)                      
                                               II.               Power and duties of Clerk : - Record/files of each branch of Municipal Council kept and maintained by related branch clerk.                                                                                                           
                                             III.               He performs his duties in field/office under the instruction of Executive Officer.    
                                                                   
3) The Procedure followed in the decision making process including channels of supervision and accountability : -                                                                               
                                                I.               General Principles: - M.C. Bagha Purana shall observe such general principles of administration as are followed in the department of the State Government.        
   
                                               II.               Channel of Correspondence with Government: - M.C. Bagha Purana shall correspond with the State Government through the Deputy Director, Local Govt. Ferozepur  and the Council may in an important case, send an advance copy of its communication to the State Government or the Director ; as the case may be.     
 
                                             III.               Language in which Business is to be Transacted, Proceedings Recorded and Notices Issued:- Punjabi Language in Gurumukhi script.   
   
                                             IV.               Administration of Oath or Affirmation of Allegiance :-
 
a.                 An oath or affirmation of allegiance under Section 24 shall be administered by the Deputy Commissioner or any other Gazetted officer appointed by him in the case of a newly appointed or newly elected member of a committee and by the Chairman of the meeting in other cases.
b.                The administration of the oath or affirmation under sub-rule (1) shall be recorded as a part of the proceedings in the minutes of the meeting.
 
                                              V.               Members not to take part in proceeding in certain cases :-No member of the committee shall be present or vote at or take any other part in any proceeding of a committee or sub-committee relating to a matter in which such member, either of his parents, or descendants of such member, or descendant of any parent of such member, or descendant or parent of the husband or wife of such member or descendant of such parent last referred to has a direct or indirect interest.
 
                                             VI.               Certain persons not to be appointed :- No person who is relation of any member of the committee in any of the manners specified in Rule 7 shall be appointed an officer or servants of, or enlisted as a contractor for undertaking any contract for such committee, without the previous sanction of the Regional Deputy Director, Local Government.
 
                                           VII.               Consideration of matter in meeting :- No matter shall be included in the agenda of a committee or sub- committee nor be discussed at any such meeting which is not connected with the functions and duties of the committee  as prescribed by the Act and it shall be the duty of the President or of the presiding member of any such matter :                                                Provided that the President or the presiding member any permit inclusion and discussion of any matter which appears to him to be in the public interest and not in any way likely to impede the administration or to promote or encourage lawlessness, or cause communal discord, or to be for any other reason undesirable.
 
                                          VIII.               Recording of minutes: - Minutes of proceedings at each meeting of a committee shall be drawn up and recoded in a book in form 1.
 
                                             IX.               Publication of minutes of meetings:- An abstract of minutes of each meeting of a committee shall be affixed at some conspicuous place accessible to the public at the place of meeting of the committee and a copy of such abstract shall be supplied to the manager of every newspaper which is published within the limits of the district in which the municipality is situated.
                                              X.               Publication of notices :-
a.                 In every case in which a notice is to be given by the committee in exercise of the powers conferred or in discharge of an obligation imposed by the Act or by any rule or bye- law made there under such notice shall be published in Form 2, duly filled in, in the following manner for the purpose of inviting objections and suggestions from the public, namely :-
a.       Such notice shall be published by proclamation.
b.       A copy of such notice together with the copy of the matter to be published shall be affixed at some conspicuous place accessible to the public at the place of meeting of the committee for a period of not less than thirty days.
c.        The notice shall be displaced on the notice boards set up for this purpose within the limits of the municipality.
d.       A copy of such notice along with a copy of the matter to be published shall be sent to the editor of the newspaper having vide circulation in the locality, to be selected by the committee for the purpose. The editors of the newspapers so selected shall be addressed as in Form 3.
e.       Every notice shall specify a date which shall not be less than thirty days from the date of its publication by which objections or suggestion by the persons interested should be submitted to the Secretary or Executive Officer, as the case may be, of the committee.
b.                (1) Simultaneously with the publication of the notice in respect of a town planning scheme under the proviso to clause (d) of sub- rule (1) the committee shall serve a notice on
a.        Every person whom the committee has reason to believe, after due enquiry to be an owner of such immovable property as is proposed to be included in the said town planning scheme.
b.       The occupier of such immovable property as is proposed to be included in the said scheme.
 The notice referred to in clause (a) shall-
(i)    State the number of town planning schemes proposed for the area.
(ii) Require such person if the objects to the said scheme to state his reasons in writing within a period of thirty days from the date of the service of the notice.                                         The notice referred to in clause (a) shall be signed by the President or the Administrator, as the case may be.
c.                 When any proposal by a committee the notice whereof is required to be published in the manner specified under sub rule (1) is forwarded for sanction and confirmation to the appropriate authority it shall be accompanied by a statement that the provisions of sub rule (1) have been duly comply with
 
d.                Publication of proposals to impose taxes or to make rules or bye- laws :-
In every case in which a committee proposes to –
                                                i.               Impose any tax under Section 61, or
                                               ii.               Make any bye- law under the Act it shall give notice of its intention in the manner prescribed in Rule 12 for the publication of public notices.
e.                When any such proposal is submitted for sanction or confirmation to the appropriate authority, it shall be accompanied by a statement that the provisions of the sub- rule (1) have been complied with.
 
                                             XI.               Fees for notices under sub- section (2) of Section 80 :-  
The fee leviable for a notice for a notice of demand served under sub- section (2) of Section 80, whether the notice is served through registered post or through a process server of the committee, shall be the postage charges, payable for a registered letter from time to time.
 
                                           XII.               Submission of annual returns, statements and reports :-
a.                 Every committee shall as soon as possible after the close of each financial year, prepare in such form as may, from time to time be specified by the Government, return relating to the constitution of the committee, the account of its income, expenditure, balances and liabilities or any other matter, together with report on the working of the committee
b.                One copy of the return so prepared shall be submitted to the Regional Deputy Director, Local Govt. by the 15th day of May in each year.
 
                                          XIII.               Removal of Members, President or Vice- President :-
a.                 The letter containing reasons for the proposed removal of a member, President or Vice- President, required to be issued under Section 16 Section 22 shall be served on that member, President or Vice- President, as the case may be, through a registered post direct by the State Govt. with a copy thereof to the Regional Deputy Director, Local Govt. with an advance copy, thereof, together with attested copies of the document accompanying it, if any, to the Secretary to Govt. of Punjab, Department of Local Govt., Housing and Urban Development so as to reach him, within a period of twenty- one days of the date of dispatch of the said letter by the registered post.
b.                The Regional Deputy Director, Local Govt. shall forward the explanation with his comments, if any, direct to the Secretary to Govt. Punjab, Local Govt. Department within a period of fourteen days from the date of receipt of the explanation under sub- rule (1).
c.                 Where a member, President or Vice President, as the case may be does not submit the explanation within the specified period, a report to that effect shall be made by the Regional Deputy Director, Local Govt. to the Govt.
 
                                         XIV.               Character verification :- No person shall be appoint as an officer or servant by any committee unless his character and antecedents have been verified before hand : 
    Provided that in the case of appointment to a temporary vacancy required to be made urgently, a person may be appointed in anticipation of verification of character and antecedents in accordance with the instructions applicable to such appointments under the State Govt.

7)                      The particulars of any arrangement that exists for consultation with or representation by the members of the public in relation to the formulation of its policy or administration thereof :-                         
As and when any new Tax is imposed, bye laws or rules are framed objections and suggestions are invited from the general public and after taking into consideration the suggestions and objections final decision is taken by the M.C. M.C. Bagha Purana vide its resolution No.80 Dated 23-2-2007 has constituted a sub committee consisting of the following 2 members of the committee for the finalization of settlement of lists for the purpose of House Tax as envisaged in section 66 of the Punjab Municipal Act,1911. The proceedings of the sub committee are open and accessible to the public.

The proceedings of the sub-committee are open and accessible to the public.
